If a driver is in an area with construction, the driver should be driving slower than the posted speed limit.

Dr. Greenbaum should have seen Mr. Alexander in enough time to stop his vehicle if he was simply paying attention.

Drivers do not anticipate pedestrians in the roadway unless the area is marked with a crosswalk.

As a pedestrian, if you choose to cross the street at an area without a cross-walk, you are aware you are taking a risk.

If Dr. Greenbaum had been driving the speed limit, Mr. Alexander would be alive today.

If Dr. Greenbaum’s vehicle could detect Mr. Alexander, then Dr. Greenbaum should have been able to detect Mr. Alexander.

If Mr. Alexander had gone back and crossed the street at a cross-walk, instead of crossing where there was no crosswalk, he would be alive today.

No one realistically walks back to a crosswalk if a sidewalk ends, so Mr. Alexander should not be faulted for crossing where the sidewalk was closed.

Juneau Construction, by failing to have signs to alert pedestrians where to cross the street safely, started a domino effect that led to Mr. Alexander’s death in this case.

Dr. Greenbaum should be taking more responsibility for his own actions in this case.

If Juneau Construction had ensured the signage was appropriate near the closed sidewalk, then this accident would never have happened.
